How Susan Works With Sellers: Transaction Broker

Florida law allows real estate licensees to work with sellers either as a transaction broker or as a single agent, and transaction brokerage is the relationship Florida law presumes unless another one is set up in writing. Susan works with sellers as a transaction broker, which is a limited form of representation. She does not act as a fiduciary, but Florida law spells out specific duties she owes you, and you'll receive them in writing with your listing agreement.

The Duties Susan Owes You Under Florida Law

  1. Dealing honestly and fairly.
  2. Accounting for all funds, such as the buyer's escrow deposit.
  3. Using skill, care and diligence in the transaction.
  4. Disclosing all known facts that materially affect the value of residential property and are not readily observable to the buyer.
  5. Presenting all offers and counteroffers in a timely manner, unless you've directed otherwise in writing.
  6. Limited confidentiality, unless you waive it in writing (see below).
  7. Any additional duties you and Susan agree to in writing.

What "limited confidentiality" protects for you as a seller: Susan will not disclose that you would accept a price lower than your asking or listed price, your reasons for selling, that you'd agree to financing terms other than those offered, or any other information you ask her to keep confidential.

What "limited representation" means: you are not responsible for the licensee's acts, and you give up the right to the licensee's undivided loyalty. This lets a transaction broker help a transaction come together, without working for one party to the detriment of the other.

What Susan Does for You

  • Prices your home with real data. Susan studies recent sales, homes under contract and active competition in your neighborhood to find the price that brings the most buyers, especially in the first weeks on the market when buyers are waiting for new listings.
  • Helps you prepare and stage. Simple steps make a big difference: fresh light, neutral paint; clean windows; decluttered closets and tables; and trimmed landscaping and fresh mulch for curb appeal.
  • Markets your home for maximum exposure to buyers who are looking now and to the agents who work with them, both online and offline.
  • Coordinates showings and keeps your home accessible to buyers and their agents.
  • Presents every offer and helps you compare them on price, terms, financing and closing date, not just the top number.
  • Negotiates the contract and any repair requests after the buyer's inspections.
  • Handles the issues that always come up with appraisals, inspections, insurance and deadlines, and coordinates with the buyer's lender and the title company through closing.

Florida Seller Disclosures

Florida sellers have disclosure duties, and getting them right up front prevents problems later. Susan helps you gather what's needed before you list:

  • Known defects. Sellers of residential property must disclose known facts that materially affect the home's value and aren't readily observable to a buyer.
  • Flood disclosure. Florida sellers must give buyers a written flood disclosure at or before signing the contract. Since October 1, 2025, it covers any flooding you know of during your ownership, any flood insurance claims, and any flood assistance received.
  • Condo and HOA documents. Condo sellers must provide items such as the milestone inspection summary and the structural integrity reserve study, or a statement that it hasn't been done. HOA and condo budgets, rules and any assessments should be ready too.

What You'll Sign

You and Susan will sign a written listing agreement that sets out the listing price, the term, and what Susan will do to market and sell your home, along with the transaction broker disclosure describing the duties above. Susan goes over every line with you before you sign, and the terms can be discussed.
