How Susan Works With Buyers: Transaction Broker

Florida law allows real estate licensees to work with buyers and sellers either as a transaction broker or as a single agent, and transaction brokerage is the relationship Florida law presumes unless another one is set up in writing. Susan works with buyers as a transaction broker.

A transaction broker provides a limited form of representation. Susan does not act as a fiduciary, but Florida law spells out specific duties she owes you. You'll receive these duties in writing before you work together.

The Duties Susan Owes You Under Florida Law

  1. Dealing honestly and fairly.
  2. Accounting for all funds, such as your escrow deposit.
  3. Using skill, care and diligence in the transaction.
  4. Disclosing all known facts that materially affect the value of residential property and are not readily observable to you.
  5. Presenting all offers and counteroffers in a timely manner, unless you've directed otherwise in writing.
  6. Limited confidentiality, unless you waive it in writing (see below).
  7. Any additional duties you and Susan agree to in writing.

What "limited confidentiality" protects for you as a buyer: Susan will not disclose that you would pay more than the price in your written offer, your reasons for buying, that you'd agree to financing terms other than those offered, or any other information you ask her to keep confidential.

What "limited representation" means: you are not responsible for the licensee's acts, and you give up the right to the licensee's undivided loyalty. This lets a transaction broker help a transaction come together, without working for one party to the detriment of the other.

What Susan Does for You

  • Plans your search around your budget, must-haves, commute and schools, and sets up listing alerts so you see new homes as soon as they hit the market.
  • Arranges private showings, including coming-soon and off-market homes.
  • Registers you at new construction sales centers. Most builders require your agent to register you on your first visit, so call Susan before you go.
  • Prices the home with real data, pulling recent comparable sales so you know what it's actually worth before you offer.
  • Builds a strong offer: price, deposit, inspection period and closing date, so you compete without overpaying.
  • Presents and negotiates offers and counteroffers, including repair requests after inspections.
  • Helps you with Florida-specific details: wind mitigation and 4-point inspections, insurance and flood quotes, the seller's flood disclosure, HOA and CDD fees, and condo documents such as the milestone inspection summary and reserve study.
  • Coordinates with your lender, the title company and inspectors and keeps your contract deadlines on track through the final walk-through and closing.

What You'll Sign

Before touring homes with an agent, Florida buyers now sign a written buyer agreement. It can cover a single property, a few homes or your whole search, and it states what your agent will do and how long the agreement lasts. You'll also receive the transaction broker disclosure describing the duties above. Susan walks you through both documents line by line before any showings. More about the buyer agreement.

Kerry DeBonis, bought 3 homes with Susan

"Susan is hands down the best realtor you can find. She's detail oriented and makes sure you have all the details before buying your new home. As first time home buyers, we felt extremely safe with Susan."
